A London bus driver, who was dismissed after developing diabetes, has been awarded just under £60,000 after winning his employment tribunal claim against his former employer.
Unfair Dismissal and Diabetes in the UK
The employment tribunal heard that the driver was dismissed on “medical grounds of capability”, after being diagnosed with Type 2 diabetes, and taking sick pay after it took a couple of months to respond to Vitamin D medication.
However, the driver took his former employer to an employment tribunal for unfair dismissal and discrimination on the grounds of his disability; and after the employment tribunal ruled in his favour, he was awarded £10,000 in injury to feelings compensation plus two years wages – which equates to just under £60,000.
